Terms and Conditions

Article 1: Definitions

1.1 “Vintage Vibes” in these Terms and Conditions means the Sole Proprietorship registered in the Commercial Register of the Chamber of Commerce in Maastricht, with Chamber of Commerce number 60051620

1.2 The customer is defined as any visitor to the showroom or webshop, natural or legal person who makes a purchase in the showroom or via email/phone.

Article 2: Applicability

2.1 These Terms and Conditions apply to all purchases in the Vintage Vibes showroom

2.2 By purchasing the customer accepts the applicability of these General Terms and Conditions.

2.3 These Terms and Conditions may be waived only if expressly agreed in writing and in which case the other provisions of these Terms and Conditions remain in full force.

2.4 Vintage Vibes reserves the right to modify or supplement these Terms and Conditions occasionally.

Article 3: Agreement

3.1 An agreement is established at the moment the customer has paid for the product (in the Vintage Vibes showroom or by bank transfer). The customer will receive a written invoice. This bill applies here, as far as the law allows, as a presumption of evidence.

3.2 If the customer and Vintage Vibes agree to make a reservation for products this will be confirmed by email. Reserved items will be held for up to 5 days after sending this email. After these 5 days, reserved items will be once again offered for sale, unless otherwise agreed in writing.

Article 4: Personal Information

4.1 The information provided by the customer will be treated confidentially by Vintage Vibes / vintagevibes.nl and may be used for the following purposes:

– Processing the order and payment thereof

– Increasing the usability of the webshop

– Provide information concerning new updates, possible promotions, and newsletter  (if the customer has opted in)

By confirming your acceptance of our Terms and Conditions you also accept our privacy and cookie policies. Please read these policies for more information about the collection, storage and use of your personal information.

Article 5: Selection

5.1 Vintage Vibes often sells used items (Vintage), traces of use can not be excluded. This is associated with the product. Without inquiring for further information before making a purchase you agree to the existing condition of the item.

5.2 Information, description, photos/images, oral communications, telephone, on vintagevibes.nl or by email provided by Vintage Vibes regarding the offer will be communicated as accurately as possible. Vintage Vibes does not guarantee all products and deals are fully compliant with the provided information. Any changes do not qualify for compensation and / or termination of the agreement in principle.

5.3 VintageVibes sells lighting mostly with the original wiring which does not always comply with the current regulations/standards. Vintage Vibes recommends consulting an electrician prior to use. Vintage Vibes sells the lamp excluding the light bulb.

5.4 Vintage Vibes can not be held to its offer if the customer, in terms of reasonableness in social attitudes, should have understood that the offer contains an obvious mistake or error.

5.5 Because products can not be automatically removed from the site after a transaction in the Vintage Vibes showroom a product may no longer be available. Vintage Vibes strives to indicate out of stock products within 24 hours of sale as “sold” / “not available”.

Article 6: Prices and Payments

6.1 All prices listed by Vintage Vibes are stated in Euros.

6.2 The articles that are considered margin items (so not the VAT products) fall under the margin regulation. With margin items, no VAT will be listed on the invoice. VAT is not deductible. If you want to know whether an item is a margin or VAT item you can request this by email.

6.3 Purchases in the showroom can be fulfilled in the following ways:

– Cash payment upon pick up of the order in the Vintage Vibes showroom (by appointment)

– Payment in advance by bank transfer; the customer will transfer the amount including shipping to bank account stating the item description. Within a maximum period of 7 days, the amount due on the relevant bank account must be credited. Upon exceeding this limit, the contract will automatically be terminated by Vintage Vibes

– Payment in advance through payment processors Paypal or Stripe.

6.4 The product will only be sent once the full total amount is credited to the bank, Stripe or Paypal account. Once an item is purchased, it will be listed as “reserved”. If 5 days after ordering the payment is not fulfilled the article will be put back on sale.

6.5 Vintage Vibes expressly reserves the right to change prices, especially when under (legal) regulations.

6.6 Special offers are only valid for the period stated on the website relating to that special offer.

Article 7: Returns

7.1 If so desired, an item may be sent back at the customer’s expense. This should be reported immediately upon receipt via email. Returns can be made within 14 days of purchase/receipt of the item, as long as the product is in the exact same condition/state as it was at the time of the sale. Costs incurred for sending to the customer and/or sending or returning items are for the expense of the buyer.

7.2 The purchase amount will be returned after the process of Article 10 is successfully concluded.

7.3 Vintage Vibes reserves the right to refuse returns or to only reimburse a portion of the amount if it is suspected that the products are used or damaged by the customer or third parties.

7.4 The purchase price, excluding transport/shipping and minus any compensation for damage to the products will be returned within 7 days on the same bank account the customer has used to pay Vintage Vibes.

In case of cash payment at the moment of purchase, the cash shall only be refunded if the products are delivered by the customer personally to Vintage Vibes. When using a conveyor we will refund the customer at the appropriate bank account, as confirmed in an email or letter to Vintage Vibes.

7.5 In the case of “Remote Purchase”, a private customer purchases the product through the Vintage Vibes shop without meeting a Vintage Vibes salesperson the following applies:

a) Private customers have the right to cancel the order within 14 days after receipt without providing any reason. The customer has then 14 days to return the goods. To exercise this right, the customer must submit the withdrawal form via info@vintagevibes.nl

b) The customer will be credited the fully paid order amount, including shipping costs (excluding any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us) Only the costs of the return of the customers’ home to Vintage Vibes will not be refunded, see paragraph 7.5 d).

c) If the customer uses the right of withdrawal, the product must be returned with all accessories and in the original condition as they appear on vintagevibes.nl to Vintage Vibes.

d) The shipping costs for returning the order will be paid for by the customer. Even when returning a portion of your order, the shipping costs are the responsibility of the customer. The purchase of the part of the order returned by the customer will be refunded to the customer excluding shipping costs.

e) We will then refund the order amount owed within 14 days of receipt of the goods – as described in section 7.5 c) – to the same bank account, the customer has used to pay.

f) Companies and business customers do not have a 14-day cooling-off period. They are expected to conduct due diligence according to the law and not on impulse.

Article 8: Delivery

8.1 Retrieving the goods is by appointment only, this will be executed in consultation with Vintage Vibes. Especially in the case of fragile / very valuable items picking up the goods is preferred!

8.2 Vintage Vibes supplies only in Europe and The United States in principle. For orders outside these destinations see article 9.2. For these deliveries, different supply conditions apply.

8.3 The items are packed in the best way possible before shipping. Should there be any damage during the shipping, Vintage Vibes cannot be held liable. The customer can optionally choose for insured delivery, the costs can be requested through the contact form on www.vintagevibes.nl.

8.4. The customer needs to check the products bought with assured delivery on damage in the presence of the delivery person/carrier before signing the waybill/receipt of the carrier. By signing the waybill/receipt the customer confirms the damage-free reception of the products.

If this check is not performed and / or the waybill/receipt is still signed damages will no longer be recovered from the carrier and/or Vintage Vibes.

8.5 Upon receipt of payment Vintage Vibes will send the order within seven days. The above delivery time is indicative and is never a final deadline. Exceeding any delivery period does not entitle the customer to compensation or the right to cancel the order or terminate the agreement unless the delay in delivery is such that the customer can not reasonably be expected to maintain the agreement.

8.6 Delivery takes place at the address provided by the customer during the actuation of the agreement.

Article 9: Shipping Costs

9.1 Shipping Costs The Netherlands: rates according to TNT Post for small items. For products that can not be shipped by TNT Post, Vintage Vibes uses a (furniture) carrier or delivers the products themselves.

9.2 For shipments to destinations not available in the Vintage Vibes webshop a different rate for each country depending on weight will be calculated. These rates can be requested via the contact form at www.vintagevibes.nl.

9.3 Typos and errors in the calculation of shipping costs are prohibited.

9.4 If the customer is not located in the Netherlands, the customer is liable for any turnover tax and/or duties.

Article 10: Retention of Ownership

10.1. The ownership of the products is passed upon payment for the products by the customer.

Article 11: Intellectual Property

11.1 The customer acknowledges that all intellectual property rights to the information, pictures/photos, announcements or other expressions concerning the products and or relating to the internet site or promotion of it belong to Vintage Vibes or other claimants. Photos, images of Vintage Vibes / vintagevibes.nl may not be used without permission.

Article 12: Force Majeure

12.1 If one or both parties are hindered due to a circumstance that is not due to negligence, force majeure, both parties are not obliged to fulfill any obligation.

12.2 The parties may suspend the obligations under the agreement for the duration of the force majeure. If this period lasts longer than two months, either party is entitled to terminate the agreement without any obligation to pay damages to the other party.

Article 13: Restitution for Damages

13.1 Vintage Vibes can only be held liable for damage that is attributable to its willful misconduct or negligence or is due to circumstances that are the basis of its risks.

13.2 Vintage Vibes is not liable for damages caused by third parties or for damages resulting from misuse or an unforeseen fault for Vintage Vibes.

Article 14: Applicable law and jurisdiction

14.1 All rights, obligations, offers, orders, and agreements to which these General Terms and Conditions apply, only Dutch law applies.
